Logic and psychology overlap in judgment, inference and proof. The problems raised by this commonality are notoriously difficult, both from a historical and from a philosophical point of view. Sundholm has for a long time addressed these issues. His beautiful piece of work [A Century of Inference: 1837-1936] begins by summarizing the main difficulty in the usual provocative manner of the author: one can start, he says, by the act of knowledge to go to the object, as the Idealist does; (...) one can also start by the object to go to the act, in the Realist mood; never the two shall meet. He is himself inclined to accept the first perspective as the right one and he has eventually developed an original version of antirealism which starts, not from considerations about the publicity of meaning, in the manner of Dummett, but from an epistemic standpoint, trying to search in a non-Fregean tradition of analysis of judgement and cognate notions a way of founding constructivist semantics. The present paper ploughes the same field. Selon la version générale de cette thèse, les facteurs qui déterminent si une croyance est justifiée, ou si elle est une connaissance, ne concernent que la vérité. Ils sont totalement indépendants des désirs ou des préférences du sujet, ainsi que des conséquences pratiques potentielles du fait de posséder ces croyances. Dans son article « Pragmatic Encroachment and Epistemic Value » (2009), P. Engel concède que des facteurs pratiques peuvent déterminer la quantité de (...) données (ou la justification) dont on a besoin pour savoir ou croire, tout en maintenant que cela n’affecte pas le purisme épistémique (dans sa version évidentialiste) sur les notions de donnée ou de degré de justification. Mais cela ne revient-il pas tout simplement à concéder l’impurisme épistémique au moins à propos de la connaissance ou de la justification simpliciter des croyances ? Dans cet article, j’examine en détails la position de P. Engel. Je montre que, correctement comprise, elle est intégralement puriste. En considérant le principe connaissance-action, je soulève néanmoins un dilemme pour son approche, jetant ainsi un doute sur le potentiel qu’elle aurait à fournir une réponse puriste satisfaisante à l’argument fondamental motivant l’impurisme épistémique. (English then french abstract) -/- This article, which can be read by non-psychoanalysts, intends to browse in four stages through the issue offered to our thinking : two (odd-numbered) stages analyzing the argument that provides its context, and two (even-numbered) of propositions presenting our views on what could be the content of the analytic discourse in the coming years. After this introduction, a first reading will point by point but informally review the argument of J.-P. Journet by showing that each (...) of its clauses may generate a “bifurcated” comment able to serve or go against the analytic discourse. Hence the interest of the “differential diagnosis” mentioned in our title, which makes glimpse the traps that the homonymy may set to this speech. The paper investigates the relationship between political oratory and literature in Romania during the second part of the 19th century. Extending the theories of Jacques Rancière, Fredric Jameson, Slavoj Žižec, and Leonidas Donskis, I analyze the relationship between politics and literature by comparing a set of illustrative speeches delivered by Take Ionescu and P. P. Carp, who distinguished themselves as brilliant political orators and also as personalities who gave up literature in order to assume a political career. My main (...) goal is to determine how much of one’s appetite for aesthetic autonomy turns into mere appetite for political autonomy, and thus for dissent and dissidence. Both examples chosen for illustration brought me to the conclusion that prior literary habits and practices into a politician’s public career can determine his/her ways of legitimizing party-switches or volatile doctrinarian attitudes. ABSTRACT BEER, P. A. C. The matter of truth in knowledge production about psychic suffering: considerations from Ian Hacking and Jacques Lacan. 2020. 250p. Thesis (PhD) – Instituto de Psicologia, Universidade de São Paulo, São Paulo, 2020. The thesis aims to reaffirm the importance of the debate around the matter of truth in relation to the production of knowledge concerning psychic suffering. Its point of departure is the understanding that the matter of truth contains two main appearances: as employed (...) to legitimize produced knowledge while establishing normative patterns, and as presenting itself in a critical form as a disruptive element to established knowledge. As such, it is a discussion that embraces both an affirmation of knowledge’s necessary character and of its variability. It will be argued in the above sense that the term “truth” must be taken as an inclusive and reciprocal gathering of epistemological, ontological, ethical and political elements. Ian Hacking’s historicized understanding of science enables such a consideration of contingent bases to scientific practice, while still producing necessary knowledge. It thus becomes is possible to establish a field in which normative understandings about scientific praxis might be criticized without it resulting in any kind of refusal or disqualification of the relevant, produced knowledge. Hacking’s proposition of a “historical ontology” and of a “dynamic nominalism” also represents an important contribution to the accumulation of knowledge production about psychic suffering debate, by affirming the ontological effects of knowledge. The way as truth is mobilized within Lacanian psychoanalysis flows from that standpoint, seen as focused on three main elements: truth’s autonomy towards the subject, (truth speaks), the opposing and temporary character of a positivized truth facing established knowledge ,(truth as critique), and the negative dimension of truth which relates to the inexhaustibility of this dialectical process of negations, (truth as radical difference). It is argued that it is possible to sustain a particular reasoning style, (in Hacking’s terms), for psychoanalysis, which is based on radical negativity. It is further argued, that the above rationalities in question work with a historicized understanding of knowledge that does not have any external (nor internal) criteria to warrant its truth. However, psychoanalysis takes negativity — arguably the base of knowledge’s variability and of truth’s disruptive character — beyond Hacking’s philosophy of science, and can thus offer even wider possibilities of thinking about the causality of psychic suffering. Even if with different intensities, both approaches signal the necessity of ethical and political implication in knowledge’s production and employment. Once there is no epistemological warranty to knowledge, its production value reverts to social agreements and ethical positioning. There is, therefore, the necessity of considering power relations. Finally, it is argued that the radical negativity sustained from psychoanalysis locates the political as an actually necessary field, inescapable by the very fact that it is not possible to crystalize any form of truth which is not the affirmation of radical difference. It is maintained then that introducing the matter of truth has as horizon the production of a kind of knowledge about psychic suffering which puts into question, at all time, its epistemological, ontological, ethical and political assumptions. This monograph contributes to the scientific misconduct debate from an oblique perspective, by analysing seven novels devoted to this issue, namely: Arrowsmith by Sinclair Lewis (1925), The affair by C.P. Snow (1960), Cantor’s Dilemma by Carl Djerassi (1989), Perlmann’s Silence by Pascal Mercier (1995), Intuition by Allegra Goodman (2006), Solar by Ian McEwan (2010) and Derailment by Diederik Stapel (2012). Scientific misconduct, i.e. fabrication, falsification, plagiarism, but also other questionable research practices, have become a focus of concern for academic communities (...) worldwide, but also for managers, funders and publishers of research. The aforementioned novels offer intriguing windows into integrity challenges emerging in contemporary research practices. They are analysed from a continental philosophical perspective, providing a stage where various voices, positions and modes of discourse are mutually exposed to one another, so that they critically address and question one another. They force us to start from the admission that we do not really know what misconduct is. Subsequently, by providing case histories of misconduct, they address integrity challenges not only in terms of individual deviance but also in terms of systemic crisis, due to current transformations in the ways in which knowledge is produced. Rather than functioning as moral vignettes, the author argues that misconduct novels challenge us to reconsider some of the basic conceptual building blocks of integrity discourse. (shrink)

At a distance of more ten years from publication (2000 French/2005 English translation), with this essay I will re-read, comment and discuss, in different way and in form of anthological sketch, the Derridean volume ‘On Touching-Jean Luc Nancy’, focusing in particular on its ‘tangents and its metonymies’, its manifold entanglements with the metaphysics of touch and bodily connections. Making use of the geometrical figure of the tangent, Derrida affirms that "[if] philosophy has touched the limit [my emphasis-J. D. ]. of (...) the ontology of subjectivity, this is because philosophy has been led to this limit”. To touch is to touch a limit, a limit without depth or surface. How have we regarded touching in the past? The body? My thesis is that if Derridean reflection remains mostly anchored to Jean-Luc Nancy’s Corpus, it is inspired nevertheless by a different deconstructive gesture/s similar to different geometric tangents (the deconstructive practice is similar to the tracing of many tangents). Discussing in particular Nancy’s Dis-Enclosure: The Deconstruction of Christianity, Derrida’essay ‘Deconstruction of Christianity’ and devoting an entire section of the book to the sense of touch in the Gospels, Derrida gives us numerous and special considerations on deconstruction and the deconstruction of touch in Christianity, admitting as well the enormity of this task. A reflection on the Kas Saghafi, “Safe, Intact”: Derrida, Nancy, and the “Deconstruction of Christianity” will follow in an exemplary way. Following a discussion of touch and the body in both animal and human spheres, in the closing section of the essay, I will comment on the Patrick Llored’s essay A Philosophy of Touching Between the Human and the Animal: The Animal Ethics of Jacques Derrida, recently published in A Companion to Derrida (2014). This study addresses highly topical questions such as: ‘What does it teach us about touch, but also about the body and the life of the animal? To what extent is it capable of renewing our knowledge [connaissance] of non-human life and of generating an animal ethics reconceived from top to bottom? If touching is coextensive with the living body, that implies not only that we place the haptical question at the centre of reflection on the animal, but also that we take into account the consequence that is most disruptive for us today (A Companion, p. 512). And conclude along with Patrick Llored that the question of touch promises to transform everything we have understood until now about animality. (shrink)

Calls for compensation are heard in many countries all over the world. Spokespersons on behalf of formerly oppressed and dominated groups call for compensation for the deeply traumatic injustices their members have suffered in the past. Sometimes these injustices were suffered decades ago by members already deceased. How valid are such claims to compensation and should they be honoured as a matter of justice? The focus of this essay is on these issues of compensatory justice. I want to look at (...) the issue from the perspective of the eradication of systematic poverty affecting particular groups—where injustices of the distant past can reliably be identified as one of the major contributory factors to people’s current poverty. In the paper I will examine the following issues: (1) What kind of injustices qualify to be remedied by means of compensatory justice? (2) Should there be a limit to how far back in history one should go to compensate for injustice? (3) How can an injustice from the distant past be reliably identified as a cause of current problems? (4) Who should be compensated? (5) Who is responsible for compensation? (6) What form should compensation take? (7) Is the concept of compensatory justice backward looking or forward looking? I will argue for a moral obligation to the effect that serious injustices, perpetrated long ago against a group of people and caused them to be poor, ought to be compensated by society in a variety of ways to the original victims (if still alive) and their descendants. Rawls champions the cause of the poor because of his strong moral sentiments about the eradication of poverty. I present these sentiments, which he converts into normative elements of his theory of justice. However, the conceptual framework and intellectual resources that he uses to articulate these sentiments are inadequate. His sentiments against poverty cannot be accommodated neatly, simply, and coherently in his liberal theoretical framework. Also, I point out that his definition of the identification of poor people as the least (...) advantaged members of society is not adequate. Therefore, his theory is refashioned so that it can properly account for the fundamental interests of poor people. An alternative conception is presented, revising Rawlsian liberalism to enable it to adequately champion the cause of the poor. I provide an alternative definition of poverty and apply Mill’s analysis of the relation between justice and utility to Rawls’ theory of justice. (shrink)

If humans may indeed legitimately intervene in conservation areas to let nature be and to protect the lives of all the diverse individual animals under their care, then the management of elephants must be legitimate as part of the conservation of natural world diversities. If this is so, to what extent are current management options ethically acceptable? In this article I address the ethics of the management options available once the judgement has been made that there are too many elephants (...) in a conservation area. I evaluate the ethical acceptability of four options, i.e., the simulation of nature, translocation, contraception, and culling. I furthermore ask whether the harsh blow of culling under very specific conditions can be softened by the taming and training of African elephants. I then examine the ethics of decision making about these issues. Before I do so, two issues must be discussed that decisively influence the management of elephants. The one is whether it is ethically justifiable to fence in elephants. The second is the ethical requirements of the scientific practice that informs management decisions. In the article I come to the conclusion that all four options are ethically flawed. All four require some violation of the important injunction to let nature be and to treat individual animals with respect. However, to do nothing and allow a loss of other species violates the important goal of conserving natural world diversity. (shrink)

In this article I present an alternative philosophy of science based on ideas drawn from the study of complex adaptive systems. As a result of the spectacular expansion in scientific disciplines, the number of scientists and scientific institutions in the twentieth century, I believe science can be characterised as a complex system. I want to interpret the processes of science through which scientists themselves determine what counts as good science. This characterisation of science as a complex system can give an (...) answer to the question why the sciences are so successful in solving growing numbers of problems and correcting their own mistakes. I utilise components of complexity theory to explain and interpret science as a complex system. I first explain the concept of complexity in ordinary language. The explanation of science as a complex system starts with a definition of the basic rules that guide the behaviour of science as a complex system. Next, I show how various sciences result through the implementation of these rules in the study of a specific aspect of reality. The explanation of the growth of science through evolutionary adaptation and learning forms the core of the article. (shrink)

Culling seems to be a cruel method of human interference in the lives of elephants. The method of culling is generally used to control population numbers of highly developed mammals to protect vegetation and habitat for other less important species. Many people are against human interference in the lives of elephants. In this article aspects of this highly controversial issue are explored. Three fascinating characteristics of this ethical dilemma are discussed in the introductory part, and then the major arguments raised (...) against human interference in the lives of elephants are evaluated. These arguments are the following: First, that nature should be allowed to run its course and establish its own balance; nature will thus solve the problem of elephant overpopulation. The second argument raised by animal-rights activists as well as by animal-welfare groups either claim that animals have rights that humans must respect at all times, or that all sentient beings have interests that humans ought to respect, as those beings can experience pleasure or pain. The third argument often associates culling elephants as method for population control with the commercial use and exploitation of wilderness areas. Many people argue that it is unethical to use wildlife as a sustainable resource for fighting poverty. In conclusion it is stated that despite these arguments human intervention in the lives of elephants are ethically justified. (shrink)

Awareness of, and respect for differences of gender, race, religion, language, and culture have liberated many oppressed groups from the hegemony of white, Western males. However, respect for previously denigrated collective identities should not be allowed to confine individuals to identities constructed around one main component used for political mobilisation, or to identities that depend on a priority of properties that are not optional, like race, gender, and language. In this article I want to sketch an approach for accommodating different (...) kinds of identity within a multicultural constitutional democracy. From a vantage point provided by a definition and explanation of personal identity, I want to show how people define, construct and change their personal identities to make themselves into unique individuals. Next I show how democratic political institutions and the personal identities of individuals reciprocally influence one another. In the final section I sketch ways in which diverse personal identities ought to be accommodated in multicultural constitutional democracies. The conclusion is that a society which gives its members the liberty, space, and opportunity to freely construct their own identities might avoid the formation of closed groups committed exclusively to their own sectional interests. Can a man be a feminist? If so, what would it mean? I want to participate in a dialogue between women and men on how to accommodate women’s moral concerns. I propose that the fundamental values of justice embodied in the South African constitutional democracy require men to be feminist. These values provide the best safeguard of the important interests and values of both women and men. Men who accept these values can support the main concerns of feminism. It is widely held that assertions are partially governed by an epistemic norm. But what is the epistemic condition set out in the norm? Is it knowledge, truth, belief, or something else? In this paper, I defend a view similar to that of Stanley (2008), according to which the relevant epistemic condition is epistemic certainty, where epistemic certainty (but not knowledge) is context-sensitive. I start by distinguishing epistemic certainty, subjective certainty, and knowledge. Then, I explain why it's much more plausible (...) to think that "certain", rather than "know", is context-sensitive. After that, I respond to an important worry raised by Pritchard, according to which the proposed view is too strong to accommodate our current practice of assertion. I then show that the main linguistic and conversational data advanced in the recent literature in favour of the knowledge condition are best explained by the certainty view. Finally, I offer two principled considerations: the certainty view is the only one compatible with three independently plausible claims and it fits very well with the common thought that knowledge does not entail certainty. Under the title 'Truth', Strawson and Evans discuss the question as to whether the distinction between genuinely fact-stating uses of language and other uses can be grounded on a theory of truth, especially a 'thin' notion of truth in the tradition of F P Ramsey.

This chapter engages with Roger Cotterrell's characterisation of the trust as 'ideological.' However, rather than agreeing with Cotterrell that the trust disguises the true ownership of the beneficiary, it shows that the family trust subverts this idea of a one-sided ownership relation altogether by effecting a reversal in the hierarchical distinction between persons and things. Under the appearance of wealth, beneficial owners are serving the very things they own by ensuring their protection and continuous reproduction.

In this paper, I reply to 18 of the essays on panpsychism in this issue. Along the way, I sketch out what a post-Galilean science of consciousness, one in which consciousness is taken to be a fundamental feature of reality, might look like.

Many philosophers agree that there is an epistemic norm governing action. However, they disagree on what this norm is. It has been observed that the word ‘know’ is prominent in ordinary epistemic evaluations of actions. Any opponent of the knowledge norm must provide an explanation of this fact. Gerken has recently proposed the most developed explanation. It invokes the hypothesis that, in normal contexts, knowledge-level warrant is frequently necessary and very frequently sufficient (Normal Coincidence), so that knowledge-based assessments would be (...) a good heuristic for practical reasoning and epistemic evaluations of action. In this paper, I raise three problems for this approach. First, I argue that Normal Coincidence is ad hoc: it relies on an unsupported frequency hypothesis that we should expect to be false given the warrant account that Gerken also endorses. Second, I argue that, in any case, Normal Coincidence is insufficient to support the hypothesis that knowledge-based evaluation of action constitutes a good heuristic. Third, I consider three other hypotheses close to Normal Coincidence apparently more likely to support the heuristic hypothesis, but I argue that they seem even more ad hoc than Normal Coincidence. Spinoza, le spinozisme et les fondements de la sécularisation est un ouvrage dédié à la mémoire d’Emmanuel Levinas, dont l’auteur a été l’élève durant plusieurs années. Il vise, à travers une analyse d’ordre philosophique, historique, épistémologique et théologique, à mettre au jour les conditions d’émergence interrelatées du spinozisme et de la sécularisation. Pour ce faire, il souligne, entre autres, l’importance des polémiques anti-maimonidiennes, des débats sur les attributs divins, la substance, l’infini, du marranisme et de la Kabbale sur la formation (...) du spinozisme, ainsi que son rapport à la pensée contemporaine. In this essay Derrida reflects, for the first time at length, on secularization as a historical process. Whereas his earlier writings on religion focus on Jewish and Christian authors who blur the boundaries of religious belonging, this essay directly questions the categories of religion and secularization. Against this background, Derrida revisits the work of Kant, Voltaire, Nietzsche, and Heidegger, and he reflects on his own engagement with messianism, negative theology, and the khôra.

A certain number of cases suggest that our willingness to ascribe “knowledge” can be influenced by practical factors. For revisionary proposals, they indicate that the truth‐values of “knowledge” ascriptions vary with practical factors. For conservative proposals, on the contrary, nothing surprising is happening. Standard pragmatic approaches appeal to pragmatic implicatures and psychological approaches to the idea that belief formation is influenced by practical factors. Conservative proposals have not yet offered a fully satisfactory explanation, though. In this article, I introduce and (...) defend a third conservative proposal which I call “Refined Invariantism”. The two main claims of this proposal are that (1) we should distinguish between high stakes cases in which the subject does not believe (that he knows) the target proposition and those in which he believes (that he knows) the target proposition and that (2) we should adopt a psychological treatment for the first kind of case and a pragmatic treatment based on the epistemic standards for appropriate assertion and action for the second kind of case. I argue that this new combined approach avoids the main pitfalls of its two conservative rivals and that it gives new life to the generality objection levelled against revisionary views. (shrink)

The Argument from Inductive Risk (AIR) is taken to show that values are inevitably involved in making judgements or forming beliefs. After reviewing this conclusion, I pose cases which are prima facie counterexamples: the unreflective application of conventions, use of black-boxed instruments, reliance on opaque algorithms, and unskilled observation reports. These cases are counterexamples to the AIR posed in ethical terms as a matter of personal values. Nevertheless, it need not be understood in those terms. The values which load a (...) theory choice may be those of institutions or past actors. This means that the challenge of responsibly handling inductive risk is not merely an ethical issue, but is also social, political, and historical. (shrink)

Within a liberal, ‘law of things’ understanding of property, the donative trust is seen as a species of gift. Control over trust property passes from the hands of settlors to beneficiaries, from owners to owners. Trust property, like all other property, is silent and passive, its fate determined by its owners. This article questions this understanding of the trust by showing how beneath the facade of ownership, the trust inverts the relation between owner and owned, person and thing. It analyses (...) the relation that trustees, beneficiaries and settlors have to the trust property and argues that the role of each of these parties can be shown to consist in furthering the interests of the trust property rather than their own. It claims that this protects things from their owners at the same time as it ensures these owners’ ongoing care towards the things they own. This raises questions about the trust’s status within the institution of private property, justified as it is by the human autonomy it is said to enable. (shrink)

La question des rapports du spinozisme à l’axiologie a fait l’objet de nombreux débats. Certains commentateurs considèrent Spinoza comme étant profondément immoraliste, alors que pour d’autres, il maintient l'ensemble des valeurs humaines. Spinoza a cherché à dépasser l’utilitarisme propre au conatus de chacun, afin de fonder un altruisme rationnel. Il souligne que le bien auquel l’homme aspire lorsqu’il suit la vertu, il le désirera aussi pour tous les autres hommes. Cependant, les moyens mis en œuvre pour démontrer cette thèse semblent (...) problématiques. Cet article analyse la logique de la coopération interhumaine élaborée par Spinoza, ainsi que son idéal de l’homme libre, montrant, qu'en fait, il n'a pas réussi à surmonter la nature profondément égoïste du conatus. -/- The question of the relationship between Spinozism and axiology has been the subject of much debate. Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. This article analyzes Spinoza's logic of interhuman cooperation, as well as his ideal of the free man, showing that, in fact, he failed to overcome the profoundly egoistic nature of conatus. -/- . The aim of this article is to bring to light some of the factors that allowed the emergence of secularization, and to understand to what extent and in what ways these factors contributed to the formation of the main lines of Spinozism. I will first examine the issues of secularization, emphasizing the importance of the transformations in the status of the Hebrew language during the Renaissance. I will then analyze the role that the Tractatus theologico-politicus may have had in European (...) culture. Finally, I will clarify Spinoza’s relationship to deism and atheism, specifying the nature of the controversies related to his religious attitude. (shrink)

The paper presents the notion of “Spirit of Nature” in Henry More and describes its position within More’s philosophical system. Through a thorough analysis, it tries to show in what respects it can be considered a scientific object and in what respects it cannot. In the second part of this paper, More’s “Spirit of Nature” is compared to Newton’s various attempts at presenting a metaphysical cause of the force of gravity, using the similarities between the two to see this notorious (...) problem of Newton scholarship in a new light. One thus sees that if Newton drew from Stoic and Neo-Platonic theories of aether or soul of the world, we need to fully acknowledge the fact that these substances were traditionally of a non-dualistic, half-corporeal, half-spiritual nature. Both More’s “Spirit of Nature” and Newton’s aether can thus be understood as different attempts at incorporating such a pneumatic theory into the framework of modern physics, as it was then being formed. This article aims to shed light on the possible influence of the Kabbalah on Spinoza. To do this, I will analyze the role that the Kabbalist theoretical model may have had on the development of Spinozist philosophy, in order to understand both their convergences and their divergences. I will then clarify Spinoza's relationship to this theory, especially the Lurianic Kabbalah, and emphasize the importance of the notion of Tsimtsum (contraction of the Divine light).

The question of Spinozist determinism and necessitarianism have been extensively studied by commentators, while the relationship between the notions of divine will and free will still requires elaborate studies. Our article seeks to contribute to such research, by clarifying the analyses of these questions by authors that Spinoza has confronted: Maimonides, as well as other Jewish philosophers, and Leibniz who criticized Spinozist determinism. We will study the consequences of these analyses on two examples that Spinoza gave to refute free will, (...) namely the dream and the situation of Buridan's ass. -/- Résumé: La question du déterminisme spinoziste et du nécessitarisme a été largement étu-diée par les commentateurs, tandis que la relation entre les notions de volonté divine et de libre arbitre nécessite encore des études plus élaborées. Notre article cherche à contribuer à ces recherches, en clarifiant les analyses de ces questions par des auteurs auxquels Spinoza s’est confronté : Maïmonide, ainsi que d’autres philosophes juifs, et Leibniz qui a lui-même critiqué le déterminisme spinoziste. Carl Schmitt's notion of nomos is commonly regarded as the international equivalent to the national sovereign's decision on the exception. But can concrete spatial order alone turn a constellation of forces into an international order? This article looks at Schmitt's work The Nomos of the Earth and proposes that it is the process of bracketing war called Hegung which takes the place of the sovereign in the international order Schmitt describes. Beginning from an analysis of nomos, the ordering function of (...) the presocratic concept moira is explored. It is argued that the process of Hegung, like moira, does not just achieve the containment of war, but constitutes the condition of possibility for plural order. (shrink)

This article provides a property analysis of electronic money, showing that the issuance of electronic money cannot involve a trust. The analysis is also applicable to other digital assets that may be said to involve a trust, and as such provides a timely contribution to current discussions on the legal nature and categorisation of digital assets both in the UK and internationally.

Standard epistemic logic actually formalizes folk-psychology. The problem of logical omniscience shows that this logic is not adequate in a cognitivist setting. In order to describe realistic information-processing believers, we need both an ontology of particulars and a hyper-intensional taxonomy of representations. From this point of view, sub-structural logics, which do not overlook the syntaxic details of the processing of information, are an interesting alternative to possible worlds semantics.

This discussion note addresses Caleb Hazelwood’s ‘Practice-Centered Pluralism and a Disjunctive Theory of Art’. Hazelwood advances a disjunctive definition of art on the basis of an analogy with species concept pluralism in the philosophy of biology. We recognize the analogy between species and art, we applaud attention to practice, and we are bullish on pluralism—but it is a mistake to take these as the basis for a disjunctive definition.

Bolzano was the first to establish an explicit distinction between the deductive methods that allow us to recognise the certainty of a given truth and those that provide its objective ground. His conception of the relation between what we, in this paper, call "subjective consequence", i.e., the relation from epistemic reason to consequence and "objective consequence", i.e., grounding however allows for an interpretation according to which Bolzano advocates an "explicativist" conception of proof: proofs par excellence are those that reflect the (...) objective order of grounding. In this paper, we expose the problems involved by such a conception and argue in favour of a more rigorous demarcation between the ontological and the epistemological concern in the elaboration of a theory of demonstration. En este artículo abordo críticamente la aseveración de David Papineau según la cual la evidencia fisiológica acumulada es suficiente para adoptar razonablemente el Principio del Cierre Causal de lo Físico y la vía negativa, viz. entender físico como no mental, como solución al dilema de Hempel. Comenzaremos restando fuerza a tal afirmación revisando el trabajo de W. Penfield y J. Eccles, dos importantes neurocientíficos y declarados dualistas. No obstante, luego nos centraremos en el trabajo de B. Libet en el que (...) se demostraría que los movimientos voluntarios están realmente determinados por causas enteramente fisiológicas, lo cual constituiría una pieza fundamental de evidencia a favor de Papineau. Nuestro análisis mostrará que no se siguen tales conclusiones. Esto tendrá consecuencias negativas para el Cierre Causal de lo Físico y con ello para el Argumento Causal para el Fisicalismo del cual el mencionado principio es premisa clave. (shrink)

During the Second World War, more than 60,000 Jewish members of the American, British and French armed forces became prisoners of war in Germany. Against all expectations, these prisoners were treated in accordance with the 1929 Geneva Convention, and the majority made it home alive. This article seeks to explain this most astonishing circumstance. It begins by collating the references to the experiences of Western Jewish POWs from the historical literature to provide a hitherto-unseen overview of their treatment in captivity. (...) It then asks what made their protection from persecution possible. To this end, it explores Germany’s wider motivations for its selective application of the Geneva Convention and highlights the role that military identity played in making its application seem necessary for all POWs from the Western front, including Jewish POWs. What does it mean to act politically? This paper contributes an answer to this question by looking at the role that necessity plays in the political theory of Carl Schmitt. It argues that necessity, whether in the form of existential danger or absolute values, does not affect the sovereign decision, which must be free from normative determinations if it is to be a decision in Schmitt’s sense at all. The paper then provides a reading of Schmitt in line with Weber’s (...) ethics of responsibility, according to which the political actor decides not arbitrarily and irresponsibly, but actively assumes responsibility for the decisions he takes. Although some authors hold that natural kinds are necessarily relative to disciplinary domains, many authors presume that natural kinds must be absolute, categorical features of the reality —often assuming that without even mentioning the alternative. Recognizing both possibilities, one may ask whether the difference especially matters. I argue that it does. Looking at recent arguments about natural kind realism, I argue that we can best make sense of the realism question by thinking of natural kindness as a relation that holds (...) between a category and a domain. Bolzano fut le premier philosophe à établir une distinction explicite entre les procédés déductifs qui nous permettent de parvenir à la certitude d’une vérité et ceux qui fournissent son fondement objectif. La conception que Bolzano se fait du rapport entre ce que nous appelons ici, d’une part, « conséquence subjective », à savoir la relation de raison à conséquence épistémique et, d’autre part, la « conséquence objective », c’est-à-dire la fondation , suggère toutefois que Bolzano défendait une conception « explicativiste (...) » de la preuve : les preuves par excellence sont celles qui reflètent l’ordre de la fondation objective. Pekakak dan Bangau sepakat untuk berbagi tugas beternak, dan tidak ada diskriminasi yang diizinkan. (...) Namun imbalannya berbeda: Pekakak bertanggung jawab untuk ikan kakap putih dan, dengan demikian, dapat memiliki lebih banyak ikan kakap putih, sedangkan Bangau mendapat ikan mas krusia. Pekakak selama ini tinggal di gua galiannya sendiri di tepi kolam, tapi sekarang dia memutuskan bahwa dia membutuhkan rumah baru. Spinoza, le spinozisme et les fondements de la sécularisation est un ouvrage dédié à la mémoire d’Emmanuel Levinas, dont l’auteur a été l’élève durant plusieurs années. Il vise, à travers une analyse d’ordre philosophique, historique, épistémologique et théologique, à mettre au jour les conditions d’émergence interrelatées du spinozisme et de la sécularisation. Il présente une recherche interdisciplinaire devant permettre d’éclairer l’origine des difficultés théoriques que ce système philosophique présente. Ce volume est le premier d’une pentalogie consacrée à Spinoza et au (...) Spinozisme, dont les autres paraîtront dans la même collection. Spinoza, Spinozism and the Foundations of Secularization is a book dedicated to the memory of Emmanuel Levinas, whose author was a student for several years. It aims, through a philosophical, historical, epistemological and theological analysis, to bring to light the interrelated conditions of emergence of Spinozism and secularization. It presents interdisciplinary research to shed light on the origin of the theoretical difficulties that this philosophical system presents. Nuestro interés en el contenido mental no-conceptual es, principalmente, la articulación de una versión sustantiva (no-trivial) de esta clase de contenido en la experiencia perceptual. El debate acerca del contenido no-conceptual ha girado, en su mayor parte, alrededor de su existencia; y los argumentos que se han ofrecido en su favor abogan por una versión no sustantiva según la cual el contenido no-conceptual es aquel que no satisface ciertos requisitos conceptuales. Así, para desarrollar una versión sustantiva del contenido mental no-conceptual (...) hemos apelado a la versión de la experiencia perceptual de propiedades espaciales ofrecida por Evans (1982 cap. 6). A partir de esto desarrollamos un nuevo argumento a favor del contenido no-conceptual de la experiencia perceptual que lo vincula a la actividad característica de la experiencia perceptual. Por último, exponemos uno de los ataques de McDowell (1996) a la noción de contenido no-conceptual y presentamos nuestras réplicas a este ataque, mostrando su insuficiencia. Al mostrar que la crítica de McDowell no es exitosa, consideramos que podríamos tener una versión del contenido no-conceptual de la experiencia que es inmune a esta línea de argumentación. (shrink)
